Air Quality Management
Air quality has become an important issue not just for large cities in Florida, but also for smaller urban and rural communities. Whether local governments can regulate air quality may depend on federal law and the state legal framework within which the local governments are operating.
In the Spring of 1999, the Conservation Clinic researched the legal and administrative basis for local air quality management. In its report, The Legal and Administrative Basis for Local Air Quality Management, the Clinic outlines the federal and state framework for air quality management, including areas that have been preempted from local regulation.
Florida state law appears to require approval by the Department of Environmental Protection before local governments can establish their own air pollution control program. The Clinic compares and contrasts structural and functional elements of the state approved, current local government air management programs in Florida and provides a comprehensive matrix of current local programs. In addition to its research on local air quality management, the Clinic moderated Alachua County's Clean Air Summit and organized a Clean Air Forum for the College of Law's Fifth Annual Public Interest Environmental Conference.
