As the academic year begins, we welcome the new and returning members of the UF Law Gator Nation — students in our J.D., LL.M. and S.J.D. programs, and our faculty and staff. This promises to once again be an active and exciting year on campus, with many visits expected from some of the nation’s leading legal professionals, public officials, and legal scholars. Visits like these are common here, and when combined with our rigorous curriculum and many other activities, have helped us earn a very strong reputation for leadership development.

For students new to UF Law, I expect your academic experience to prepare you to be not only an effective legal practitioner but also a better citizen and leader in your community and the legal profession. Make the most of your time here, not just in class, but by developing strong relationships with your fellow students and future colleagues. Our alumni tell us they call on these relationships often throughout their careers, and great rewards can be found by reaching beyond your comfort zone to develop friendships with classmates very different than you. Our faculty and every student accepted here have records of extraordinary accomplishment, and we can all learn much from each other.

Please visit our website at www.law.ufl.edu and carefully read the University of Florida Student Honor Code. Academic honesty and integrity are fundamental values of the UF Law community, and students who enroll at UF commit to holding themselves and their peers to the highest standard of honor required by this code. Also, our website contains important policies and guidelines to which students and other members of our community are expected to adhere. You are preparing to become a part of a noble profession; this means your professional reputation and legal career begin here, and it is vital that you act accordingly.

Our website also offers details and updated information on support services, financial information, student organizations, centers and institutes, course descriptions, faculty and staff, maps and other helpful resources. And each week class is in session, be sure to read FlaLaw Online or in your email to keep up with the many activities and events at the law school, including important information about career development and student services, alumni activities and more.

It is great to be a Florida Gator. Welcome to the Levin College of Law.

Some of you may have seen this message in the 2012-2013 Calendar & Student Handbook. If you would like a copy, please visit the Office of Student Affairs.

Omri Marian joins the University of Florida Levin College of Law faculty as an assistant professor of law after most recently working as a tax associate at Sullivan & Cromwell, LLP in New York.

Originally from Israel, Marian served in the Israeli Navy for six years as a submarine officer before attending Tel-Aviv University.

Marian graduated magna cum laude in 2006, earning a bachelor of art in political science and an LL.B from Tel-Aviv.

In Israel, law degrees are conferred after completion of undergraduate studies. Graduates may sit for the Israeli bar exam after completion of a one-year post-graduate internship with a law firm. He fulfilled his internship at Gornitzky & Co. Advocates and Notaries.

Marian moved to the United States to attend the University of Michigan Law School. There, he earned his LL.M in International Taxation in 2008 and a S.J.D. in 2009.

Marian worked as a tax associate for Sullivan & Cromwell LLP in New York City for two years before realizing he wanted to teach.

“I’ve had great teachers,” Marian said. “They are the reason I want to teach.”

The tax program is what attracted him to UF Law. Marian called it the “hallmark of all tax programs.”

Marian will teach International Tax I in the fall semester and International Tax Planning in the spring.

He said he looks forward to class and bonding with students. He wants students to understand the material deeply enough to think critically about it and share their own ideas. He hopes his enthusiasm for teaching will foster a successful learning environment.

“In order for teaching to work, you have to enjoy it,” he said.

On Friday, the Florida Moot Court Team will showcase its new members in the 27th annual Zimmerman Kiser Sutcliffe Final Four Competition at 10 a.m. in the Martin H. Levin Advocacy Center.

The top four competitors from this year’s tryout competition will demonstrate their oral advocacy techniques before a panel of judges including Judge Stephanie W. Ray of the Florida First District Court of Appeal, Judge T. Kent Wetherell, II also of the Florida First District Court of Appeal, and Senior Federal Judge Stephan P. Mickle of the Northern District of Florida. Blake Neumann and Ian Dankelman will represent the petitioner, the United States Government; Megan Coughlin and Cullen Boggus will represent the respondent, Jack Fritz; and Nathan Diehl has been selected as an alternate for the competition.

This year’s competition issue delves into the pressing concerns of cellphone privacy under the Fourth Amendment and a minor’s right to counsel under the Fifth Amendment. These current, polarizing social issues will spur compelling arguments and zealous advocacy. Given that seating will be limited in the Advocacy Center, the arguments will be displayed simultaneously via video in HOL180 and will also be broadcast online at http://mediasite.video.ufl.edu/Mediasite/Play/cf497b23132d471096761dc5c34c2c871d.

Congratulations to new members who will be on hand to support the final four: Chelsey Clements, Jessica Clements, John Curry, Dick Eagles, Arielle Eisenberg, Alfredo Ferrer, Victoria Forson, Kristina Gandre, Stephanie Generotti, Matthew Goodwin, Heather Griffin, Alex Kruzyk, Kate Livanec, Matthew Moats, Joey Posey, DeeDee Scheller, Jennifer Smith, Robert Sowell, Kevin Stone, and Danielle Tamir.

In addition to the intramural competition, the Florida Moot Court team sent two teams to compete in competitions across the state this summer: Danielle Grundt, Ryan Hopper, and Dylan Shea represented the team in at The Florida Bar Competition in June. Will Anderson, Ryan Gilbert and Tyler Hudson represented the team at the Earle Zehmer Worker’s Compensation Competition in August. Both teams performed strongly and Ryan Hopper won Best Oralist at the Florida Bar Competition. The team looks forward to an active competition schedule this fall.

Whether you are joining us for your first year of law school or are a returning student, welcome to the 2012-2013 academic year. I’d like to take this opportunity to provide you with some information related to campus emergency and safety issues, as well as provide a reminder about where you can find information about weather and related emergency situations.

Emergency Response Information:

We are now in the heart of the hurricane season. The Levin College of Law follows University of Florida policies and procedures regarding school closings and other matters, and the latest information will be posted on the UF Home page at http://www.ufl.edu/. Updated information on school closings and related matters will also be available on local radio and TV stations and by calling UF at 352-392-3261 (which is activated during emergencies only). You can also link to this information from the law school home page at http://www.law.ufl.edu/

Hurricanes give us time to prepare a response, but some situations do not:

In the event of a fire or other emergency at the law school, please proceed quickly but carefully to the nearest exit, then continue at least 50 feet away from the exterior of the school. Do NOT go to the law school courtyard.

If a severe storm or tornado occurs while you are on the law school campus, please go to or remain in an inside, windowless classroom or other facility. Instructions are posted in each classroom and in other spaces on the law school campus. Examples include the Rare Book Room, internal library meeting rooms, and Bailey Courtroom.

Our facilities are equipped with the Informacast Emergency Broadcast system, which will be used to broadcast emergency messages as necessary throughout our buildings through telephones and speakers in the offices, classrooms, courtyard, and student gathering spaces.

In addition, we have three Automated Emergency Defibrillators (AEDs) in our buildings. One is located on the third floor outside room 382, one in the Legal Information Center lobby, and one in Bruton-Geer outside the Center for Career Development. In the event of a cardiac arrest, please call 911 immediately, but also follow the instructions on the signs above the AEDs. Those instructions provide the numbers to the Dean’s Office and the Legal Information Center who will assist in the response.

Flu Season:

The H1N1 flu outbreaks in recent years reminded us all of good hygiene practices, such as washing your hands frequently and avoiding touching your eyes and mouth with your hands. You may also have noticed that we have hand sanitizer dispensers at multiple locations around the law campus, and I encourage you to use them. Such practices will help to contain any seasonal flu outbreaks that may develop. I also encourage you to visit the Student Health Care Center for information about vaccinations that are available to students at http://shcc.ufl.edu/services/primary-care/flu/. In addition, it is our practice to make flu shots available at the law school as flu season nears.

Security:

The safety of our students is of utmost importance to our campus community. Please do not prop open the doors after hours, as this practice compromises not only your safety but the security of the facilities overall. When leaving the law campus area after hours, use resources such as SNAP, or Student Nighttime Auxiliary Patrol, made available to you by the University Police Department. You may request a walking escort or a ride with SNAP via telephone at 392-SNAP (392-7627). For more information about SNAP call the UPD Community Services Division at 392-1111.

The beginning of each academic year holds great anticipation and excitement for all of us. I wish you a successful, healthy, and safe 2012-2013.

In the age of Google, the use of libraries and librarians may seem obsolete. But it is worth remembering at the start of a new school year that the Lawton Chiles Legal Information Center is an invaluable print and digital resource for students, faculty and the public.

Librarians are knowledgeable in digital literacy and libraries have resources that may only be available in print.

The law library is staffed with experts in navigating online databases and electronic resources as well as the 625,000 volumes of books, journals, videos and other materials. In addition to providing comprehensive guidance for research in law, the library’s staff aids its patrons in researching related fields in the sciences, social sciences and the humanities.

“People think of a library as a quiet place where you go and look at dusty books and you sit and study, but we’re so much more than that,” said Shira Megerman, student services reference librarian.

The 78,000-square-foot building provides patrons with a wide variety of legal resources and materials on Florida, federal and international law as well as a distinguished collection of federal taxation and British Commonwealth materials.

Claire Germain, associate dean for legal information and Clarence J. TeSelle Professor of Law, describes the library’s mission as advancing legal research, scholarship, and education by providing outstanding and innovative information services and resources to the law school, the university, and the public.

As the largest academic law library in the Southeast, it aims “to prepare students for the practice of law so that they can be effective researchers and to support faculty and student scholarship,” Germain said.

The library’s name reflects the multiple formats available for legal information since the development of new technologies and the Internet, from microfiche to databases.

The librarians are authorities on how to use these databases and “offer several courses that teach students how to search the deep Web not exposed through Google, hidden materials, and unknown databases. The courses also teach students how to come up with a research methodology,” Germain said.

While reference librarians cannot give legal advice, they will guide patrons to legal resources and help them with legal research.

“We are a very open environment. We are not trying to be stogy or difficult or not supportive of their endeavors. We really want them to make this a type of home,” Megerman said. “We’re approachable. We’re knowledgeable. Use us as tools.”

The Student Library Advisory Committee is comprised of 10 students and includes 1Ls through 3Ls and LL.M. candidates. The library utilizes this committee for feedback and to develop policies that reflect their desires. SLAC discusses topics such as study rooms, food in the library and check out procedures.

The library also serves the UF Law faculty through a liaison program in which each faculty member is assigned a librarian who helps them in their research. The library benefits from this program as well through collection development.

“They are helping us buy good books for the library,” said Elizabeth Outler, associate director and head of public services.

While doing research, faculty members request books that pertain to their field and the library orders them. The books are then available for others to check out.

The library also strives to aid the public. Outler said all the resources that are available on the computers for the faculty and students, beside those that require a login, such as Lexis and Westlaw, are also available to the public.

“The difficulty that we run into, which is common for law librarians everywhere, is that they want you to give them legal advice,” Outler said.

(Photo special to FlaLaw)

When she’s not busy chasing after her two young ones, Samantha Schosberg Feuer (JD 02) is protecting consumers from fraud as the South Florida bureau chief of the Economic Crime Division of the Florida Attorney General’s Office located in West Palm Beach.

Students considering practice in public interest law can take notes from a graduate who was once in their shoes.

Feuer says litigation experience is crucial. And for those wanting to pursue a career in criminal prosecution, experience at a state attorney’s office or public defender’s office will serve them well.

Getting as much hands-on work experience as possible through internships is the key to future success and discovering your passion, she said.

Feuer stressed choosing an internship that is closely related to the type of law you see yourself practicing, but this can be problematic as few students know exactly what type of law they want to practice after graduation.

The choice shouldn’t be made in a rush, but the more one can narrow down the possibilities, the more beneficial those internships will be in the future.

“It’s ok to make mistakes and take risks; that’s how you learn what you are passionate about in your legal career,” she said.

Her recommendations are to find out as much as possible about the field of law that interests you and to seek advice from alumni.

Graduates, she said, should seek out guidance from alumni because they are typically willing to help.

“UF alumni make up a close-knit community and they will be very likely to assist recent graduates in their careers,” Feuer said.

Her words of encouragement for future and recent graduates focused on the economy and the value of a UF Law degree.

Students are faced with many financial challenges during these economic times. However, Feuer believes that economic trends are shifting for the better and the future looks promising for law students.

“Your UF degree is especially valuable when you’re looking for a job in Florida,” Feuer said

Feuer’s love for the law started at a young age.

“I knew I wanted to be a lawyer since I was nine years old,” she said. It started with her heated discussions with her dad, when he would say “save it for the courtroom.”

Her love for the law carried her through law school and various legal internships. Fortunate enough to have extremely supportive parents, Feuer had the opportunity to work as a legislative correspondent for Sen. Bob Graham, in Washington, D.C., after she graduated from Tufts with her undergraduate degrees in Spanish and International Relations.

While in school, her continued passion for public service and giving back to the community sparked her interest in criminal prosecution.

After graduating from UF Law, Feuer started out her legal career as a criminal prosecutor in the Miami Dade State Attorney’s office where she met her husband, fellow attorney Leonard Feuer.

Of all of the challenges Feuer faces daily, she says the biggest one is balancing work and family. This proves to be a concern for many female lawyers who want both a family and a career. Her advice for finding the balance would be to choose the right significant other.

“The person you chose to spend the rest of your life with makes a tremendous difference in the success of your career,” she said. Fortunately, Feuer chose wisely and she and her husband share the parenting responsibilities equally for 5-year-old Sophia and 2-year-old Jack.

As for what the future of consumer protection law holds, Feuer predicts that the Internet will be the focus as issues of Internet privacy and online scams become more prevalent.

In her spare time, Feuer is an avid reader and heads a book club. Her favorite book is A Hope in the Unseen by Ron Suskind. Currently Feuer is reading Wild by Cheryl Strayed a story about a woman who hikes the Pacific Crest Trail alone and discovers herself along the way.

Feuer also enjoys scrapbooking and says it provides her with a creative outlet.
