<p>Attila Andrade Jr. has written a text book for his students, entitled <em>Doing Business in Latin America</em>. The book has been available as a courtesy to his &#8220;Doing Business in Latin America&#8221; course participants and has received high praises from the student body. <p>This article discusses the debate over the large cost of legally challenging capital punishment before the execution of a prisoner.</p>
<p>From the article:<br />
George R. &#8220;Bob&#8221; Dekle Sr., a legal skills professor at the University of Florida agreed with Bakkedahl. The 29-year former state prosecutor said some defense lawyers specializing in death row appeals &#8220;feel their duty to their client trumps their duty&#8221; to the system.</p>
<p>&#8220;If the client is guilty and deserving of death, then the last thing they want is for the system to work properly,&#8221; he said. &#8220;The more monkey wrenches that can be thrown into the system, the longer the client lives.&#8221;</p>
<p>Regional counsel officials though, flatly reject positions like Dekle&#8217;s and Bakkedahl&#8217;s. They insist by vigorously pursuing death row appeals, they&#8217;re fulfilling a statutory duty: to represent clients facing execution in a dauntingly complex area of law.</p>

<p>Nancy Dowd presented her article “Identities and Vulnerabilites: The Case of Black Boys” at “Vulnerabilities and Identities:  An Uncomfortable Conversation” at Emory University School of Law in September.  This month, she presented “What Men?  The Essentialist Error of The End of Men” at a Boston University School of Law symposium. Additionally, the paperback version of Dowd’s <em>Justice for Kids: Keeping Kids Out of the Juvenile Justice System </em>will soon be published.</p>

<p><a href="http://www.alligator.org/news/local/article_c6af7a6e-0e9f-11e2-aead-0019bb2963f4.html?TNNoMobile">“Gainesville ranked no. 1 for pirating” (Oct. 5, 2012, The Independent Florida Alligator) </a></p>
<p>In terms of illegal downloads, Gainesville has become the pirating capital of the U.S., followed by Albany, Ga.; Fairbanks, Alaska; Lexington, Ken., and Tallahassee.</p>
<p>From the article:<br />
Amy Landers, visiting professor of law at UF, said the study doesn’t necessarily mean Gainesville’s residents — particularly students — don’t care about copyright laws. She said because the study doesn’t track the identities of users, there’s no reason to jump to the conclusion that UF students are to blame.</p>
<p>“There’s no reason to think that a college student would be less respectful of the law,” she said.</p>
<p>Landers, who specializes in intellectual property law, said she recommends avoiding all illegal downloading.</p>
<p>“It is a civil and criminal violation of the law,” Landers said. “The music industry has been aggressive about pursuing lawsuits.”</p>

<p><a href="http://www.nytimes.com/2012/10/07/us/floridians-face-initiatives-on-abortion-and-church-and-state.html?_r=0"> “Voters in Florida are set to weigh in on two contentious ballot questions” (Oct. 6, 2012, <em>The New York Times</em>) </a></p>
<p>The article discussed the two ballot questions Floridians would have to vote on in the upcoming election: abortion and separation of church and state. The first measure would restrict abortions and the second would allow public money to flow to religious institutions.</p>
<p>Striking down these initiatives is among the ideas being talked about in regards to these two questions, as is rewording the questions to have a different meaning.</p>

<p>Diane Mazur published an op-ed at Rick Hasen&#8217;s Election Law Blog, entitled &#8220;Should We Have VIP Lanes for Military Voters?&#8221; The op-ed responds to misrepresentations about Ohio military voting rules and revisits similar problems during the Florida presidential recount in 2000.</p>
<p>Mazur also published an article, entitled “The Constitutional Bond in Military Professionalism,” in the <em>Texas Law Review</em>. In the article, Mazur explains why a close bond to constitutional ideals is a benefit to the military and not a burden.</p>

<p>The Supreme Court of California, in addressing what standard to adopt for competence for self-representation at a criminal trial, favorably cited Johnston&#8217;s article. The court did not mandate that lower courts adhere to Johnston&#8217;s proposed standard, but it detailed her proposal and characterized it as &#8220;plausible&#8221; and &#8220;helpful to the extent (it) suggest(s) relevant factors to consider.&#8221; The court then stated, &#8220;Experts asked to examine defendants for this purpose, and trial courts called on to make these rulings, may consider these factors (identified in part by Johnston) in their examinations and rulings.&#8221;</p>
<p><strong>Lyrissa Lidsky</strong> <em><br />

<p>On Jan. 26, Lidsky presented a paper entitled &#8220;Not a Free Press Court?&#8221; at a conference at Brigham Young University Law School on The Supreme Court and the Press that included legal journalists, media law professors, and political scientists.</p>

<p>Following the tragic traffic accidents and deaths just south of Gainesville due to low visibility from brush fires on Paynes Prairie, questions have been raised about where to lay blame and possibilities of pursuing legal action. Lidsky commented on the various potential targets of lawsuits, including the Florida Highway Patrol, trucking companies whose trucks were involved in the accidents, and possibly the person(s) who started the fire at Paynes Prairie.</p>
<p>From the article:<br />
Lidsky said trucking companies might be sued because of their insurance and could be found negligent if their drivers&#8217; actions were shown to be unreasonable.</p>
<p>&#8220;It doesn&#8217;t necessarily absolve all of these drivers of responsibility&#8221; if the highway patrol re-opened the road, she said.</p>
<p>A remaining target of a possible civil lawsuit is the person responsible for the fire, if one is identified. Lidsky said negligence is limited to foreseeable harm, but that courts have been willing to stretch the concept when faced with an intentional action such as arson.</p>
<p>&#8220;It doesn&#8217;t seem utterly unforeseeable that (a fire) would affect roadway visibility,&#8221; she said.</p>

<p>This article addresses questions raised after an attack was captured on film of a Marion County student by other students on a school bus. Little discussed the possibility of a lawsuit against the Marion County school system because some said the bus driver did not do enough to prevent the fight from occurring.</p>
<p>From the article:<br />
The victim in the case could have the basis for a lawsuit against the school district, according to Joseph W. Little, professor of law emeritus at the University of Florida Levin College of Law. He said the victim could argue &#8220;the driver was negligent (in) not coming to the assistance of the person at risk, or that the school district was negligent in training the driver,&#8221; or both.</p>

<p>In January, Rebouché gave the lecture on prenatal genetic testing for the monthly seminar series at Johns Hopkins Berman Institute of Bioethics and presented a paper on comparative abortion law at the feminist legal workshop at George Washington School of Law.</p>

<p>Last year saw the largest increase &#8220;in the size of intellectual-property jury awards&#8221; in the history of the United States, partially due to two major lawsuits by DuPont Co. and St. Jude Medical Inc. in an attempt to protect trade secrets. Rowe said this practice by large companies is becoming more common.</p>

&#8220;Companies are becoming more aggressive and more willing to pursue these cases,&#8221; said Rowe, who teaches intellectual- property law at the University of Florida. &#8220;As more and more of these cases go to trial, it encourages people to bring them. You have a growing body of precedents,&#8221; she said.</p>

				<content:encoded><![CDATA[<p>More UF Law faculty members than from any other unit on campus consistently educate the public on legal aspects of current issues by lending their vast and diverse expertise to the media on a wide variety of topics. UF Law professors contributed to more than 60 unique news articles during fall semester of 2010 alone, resulting in stories in close to 200 media outlets ranging from local papers like <em>The Gainesville Sun</em> to national outlets such as <em>The Associated Press</em>, <em>Newsweek</em> and <em>The New York Times</em>. A special thanks goes out to professors Diane Mazur, Joseph Little, Lyrissa Lidsky, Michael Allan Wolf, Michael Seigel, Alyson Flournoy, Jon Mills, and Dean Robert Jerry, whose commentary appeared in multiple articles throughout the semester. Mazur&#8217;s opinions on the military&#8217;s &#8220;don&#8217;t ask, don&#8217;t tell&#8221; policy earned particular prominence. In addition to publishing an op-ed piece in <em>The New York Times</em>, her quotes appeared in at least 100 publications.</p>
