::Guide to Using the
Florida Administrative Code
The Florida
Administrative Code is the official compilation of the
rules and regulations of Florida regulatory agencies. Its
counterpart in the federal system is the Code of Federal
Regulations. The Florida Administrative Code (FAC)
is organized by titles with each title number representing
a department, commission, board or other agency.
The FAC states
the rule followed by statutory authority, implementation
and a history of the rule. The set is annotated with decisions
of the Federal courts, State appellate courts, State Attorney
General opinions, final and recommended orders of the Division
of Administrative Hearings and final agency orders construing
the rules. Citations for the Florida Bar Journal
and the law reviews of Florida State, the University of
Florida, the University of Miami, Stetson and Nova are also
included.
The set has a single
comprehensive index volume. The spines of the volumes indicate
which titles are included, but no reference is made to the
names of the titles. Use of the index, or a citation from
another source, is necessary to enter the text.
::Tracing the History of a Rule
At the end of each
rule in the FAC, a history note is located in the italicized
text which begins with the words "Specific Authority". The
history note indicates when the rule has been modified,
renumbered, or repealed.
::Statutory Cross Reference Table
The Statutory Cross
Reference Table volume lists Florida statutes in numerical
order. Numbers in bold type indicate that the rules listed
have the statute as authority. Numbers in italic indicate
that the rules were implemented under that statute.
::Updating
The FAC is
updated each month. Pages within the titles are replaced.
There will be an indication of when the pages were last
revised (e.g.: R.5/90 - May, 1990) printed in a top corner
of the page on either the front or back. The researcher
will also want to check for color pages in the front of
the volume or title. They will have a statement on the first
page indicating the period of coverage.
Repealed regulations
are listed in the front of the Index volume.
The Florida Administrative
Weekly is the first place where new regulations and
revisions are printed. As the title indicates, it is published
weekly. In the back of each issue is a cumulative table
entitled "List of Rules Affected." The list is by rule number
and gives citations to the Florida Administrative Weekly
volume and page where altering action has been either proposed,
amended or adopted. If the citation has a letter with it,
check the beginning of the "List of Rules Affected" section
for explanation of the coding. Each Florida Administrative
