Section 1.7 - Disadvantages of Electronic Public Access

Technical Limitations
Most reported disadvantages are in the technical limitations of the court computer system. Electronic Public Access of multiple courts is a complex problem. The databases and court record layouts of individual counts and courts are diverse. Each county has its own style which is often reflected in its computer database. Likewise, the infrastructure of each county’s communications with other public and private agencies represent similar diversities.

Court Interaction
Lack of human interaction can result in undetected mistakes or misinterpreted information by the public. The public may not have the necessary knowledge to understand how to access particular types of information in the court systems and they may have problems interpreting the available information.

Obsolete Personal Computers
Many communities are recycling computers, with business and government agencies donating computers to the community and organizations when they upgrade. These older computers may not have the capabilities to access court records electronically, due to the technology requirements imposed by the court systems.

Compromised Security
As more courts go online providing electronic access via the Internet, there are issues of security to take into account. Today’s Internet Web servers and software are built with extra levels of security, firewalls, and management. Even so, there are scattered reports of unauthorized access to systems. Using 3rd party providers, there is an extra level of security, since their systems access the courts directly.
